Terms of Service

1. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old and authorized to bind your organization to these Terms.

2. Subscription Plans and Payment

The Service is offered under tiered subscription plans as published at /pricing, plus optional add-ons. Pricing and plan details may be updated with at least 30 days' notice for existing customers.

• Paid plans are billed monthly or annually in advance.
• Annual subscriptions receive a 20% discount.
• Taxes (including GST in India) are added at checkout where applicable.
• Failure to pay may result in account suspension after a 14-day grace period.

3. Refunds and Cancellation

You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period. We offer a 14-day refund window for first-time annual subscriptions; monthly subscriptions are non-refundable. Refund requests should be sent to billing@trendnautlabs.in.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Send spam, unsolicited bulk email, or violate anti-spam laws (CAN-SPAM, India Telecom Regulations, GDPR).
• Upload content that is unlawful, defamatory, infringing, or harmful.
• Attempt to gain unauthorized access to other accounts or our infrastructure.
• Reverse engineer, decompile, or attempt to extract source code.
• Interfere with the integrity, performance, or availability of the Service.
• Use the Service to compete with us or build a competing product.

Violation may result in account suspension or termination without refund.

5. Intellectual Property

We own the Service.All rights, title, and interest in the Service, its underlying technology, software, designs, and trademarks (including the "Trendnaut" name) are owned by Trendnaut Labs.

You own your data.You retain all rights to the data you upload or generate within the Service ("Customer Data"). You grant us a limited, non-exclusive license to host, process, and display your Customer Data solely to provide the Service to you. We will not access your Customer Data except: (a) at your request to provide support, (b) to maintain the Service, or (c) where required by law.

6. Data Ownership and Export

Customer Data remains yours at all times. You may export your data in CSV format from the Service at any time. Upon termination, you have 30 days to export your data, after which it will be permanently deleted.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be announced at least 48 hours in advance via the status page. We are not liable for downtime caused by third-party providers, force majeure, or your network.

8. Warranties and Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Trendnaut Labs' total liability arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless Trendnaut Labs, its officers, employees, and partners from any claims, damages, or expenses arising from: (a) your use of the Service in violation of these Terms, (b) your Customer Data, or (c) your violation of any third-party rights.

11. Termination

You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a manner that exposes us to legal risk. Upon termination, your right to use the Service ends immediately. Sections 5, 6, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts of Bengaluru, Karnataka, India. The parties agree to first attempt good-faith negotiation for 30 days before initiating formal proceedings. Either party may seek injunctive relief in any court of competent jurisdiction without first attempting negotiation.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
